using the website (https://www.snagsight.com) and the Snag Sight mobile application, please carefully read
these terms and conditions ("Terms", "Terms and
Conditions") (the "Service")
Your
acceptance of and adherence to these Terms will govern your access to and use
of the Service. All users, visitors, and other individuals who use or use the
Service are subject to these Terms. You warrant that you are at least 18
years old and that you are able to legally form contracts. If you are under 18,
you guarantee that your parent or legal guardian has given their approval and
that they accept the terms of this agreement on your behalf if you are under 18.
You
consent to being legally bound by these Terms by accessing or using the
Service. Access to the Service is not permitted if you disagree with any part
of the terms.
Changes to Application and Web portal
Any component or element of the Service, including but not
limited to its content, availability, and required equipment for access or use,
may be changed or discontinued at any time by us.
Subscriptions
Subscriptions ("Subscription(s)") are used to pay for
some components of the Service. Periodically and recurrently, you will receive
an advance billing ("Billing Cycle"). Depending on the sort of
subscription plan you choose when buying a Subscription, billing cycles are
established either on a monthly or annual basis.
If you do not cancel your Subscription before the end of the
applicable Billing Cycle, it will renew itself at the end of the following
billing cycle subject to the exact same terms. Through the subscription control
option on your online account, you can stop your subscription from renewing.
To process the payment for your Subscription, a legitimate
payment method, including a credit card, is necessary. You must give us correct
and complete billing information, which must include your full name, address,
state, zip code, phone number, and information about an authorized payment
method. By submitting such payment information, you automatically authorize us
to charge all Subscription fees incurred through your account to any such
payment instruments.
If for whatever reason automatic billing is unable to take
place, we may send you an electronic invoice with instructions that you must
manually complete the full payment for the relevant billing period by a
specific deadline.
If your Subscription expires due to cancellation or non-payment, we will, after a 30-day period, be under no obligation to maintain your data and will have the right, unless prohibited by law, to delete or otherwise dispose of all information related to your Subscription that is in our possession or control.

Trials
From time to time, We may offer trials of Paid Subscriptions for a specified period without payment or at a reduced rate ("Trial(s)"). Snag Sight team may determine your eligibility for a Trial, and withdraw or modify a Trial at any time without prior notice and with no liability, to the extent permitted under applicable law.
For some Trials, we'll require you to provide your payment details to start the Trial. By providing such details you agree that we may automatically begin charging you for the Paid Subscription on the first day following the end of the trial on a recurring monthly basis or another interval that we disclose to you in advance. If you do not want this charge, you must cancel the applicable paid subscription before the end of the trial by contacting us.
Access to the additional features of the service offered by the trial will only continue after the trial period if a separate agreement is made between you (or a business which you represent) and Snag Sight, which explicitly provides continued access to the additional features of the service. In the absence of such agreement the additional features provided by the trial will be suspended at the end of the trial period.
Fee Changes
Snag Sight reserves the right to change the fee for the
subscriptions at any moment and in its sole discretion. At the conclusion of
the then-current Billing Cycle, any changes to the Subscription fee will take
effect.
To provide you the chance to cancel your subscription before a
change in subscription prices takes effect, Snag Sight will give you fair
advance notice of any such change. Your agreement to pay the adjusted
Subscription fee amount is evidenced by your continuing use of the Service
following the implementation of the Subscription price modification.
Refunds
The paid Subscription fees are not refundable unless mandated by
law.
Content
Our Service allows you to store, share and otherwise make
available certain information, text, graphics, or other material
("Content"). You are responsible of the legality,
dependability, and appropriateness of the Content that you publish to the
Service.
You acknowledge and agree that the Snag Sight may access your
Content and may use, modify, reproduce, distribute, display, and disclose your
Content as necessary to operate, maintain, or improve the Service. The Snag
Sight may also use third-party service providers to assist in providing the
Service to you. Any third-party service providers utilized by the Snag Sight
will only be given access to your Content as is reasonably necessary to provide
the Service.

When using or accessing the Service, you agree not to:

You are required to give us true, comprehensive, and up-to-date
information whenever you register an account with us. Your account on our
Service may be immediately terminated for violating the Terms if you don't
comply with their requirements.
You are responsible for safeguarding the password that you use
to access the Service and for any activities or actions under your password,
whether your password is with our Service or a third-party service.
You must not assign or otherwise dispose of your account to any
other person. You promise not to share your password with anyone. You
acknowledge that you bear complete responsibility for all actions taken in
connection with your account or password. Any security breach or unauthorized
use of your account must be reported to us right away by you.
You are not permitted to use as a username the name of another
person or entity, a name or trade mark that is not legally yours and is
protected by the rights of another person or entity, a name or trade mark that
is otherwise offensive, vulgar, or obscene.

The Service, including all of its features, functionality, and
original content (apart from User-Provided Content), is and will continue to be
the sole property of Snag Sight and its licensors. The Service is shielded by
trademark, copyright, and other legal provisions.
You may only use the Service in ways that we have approved for
you to do so. A limited, non-exclusive, revocable, non-transferable permission
is granted to you as a user to use the Service to produce, display, utilize and
download Content in accordance with these Terms.
Our Intellectual Property must not be used in connection with a
product or service that is not affiliated with us or in any way brings us in
disrepute.
Any opinions, advice, statements, services, offers, or other
information or content expressed or made available by any other users are those
of the respective authors or distributors and not of us.
Termination
We may terminate or suspend your account immediately, without
prior notice or liability, for any reason whatsoever, including without
limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately
cease. If you wish to terminate your account, you may simply discontinue using
the Service.
All provisions of the Terms which by their nature should survive
termination shall survive termination, including, without limitation, ownership
provisions, warranty disclaimers, indemnity and limitations of liability.
We shall not be liable to you or any third party for any claims
or damages arising out of any termination or suspension or any other actions
taken by us in connection therewith.
If applicable law requires us to provide notice of termination
or cancellation, we may give prior or subsequent notice by posting it on the
Service or by sending a communication to any address (email or otherwise) that
we have for you in our records.
Indemnification
As a condition of your access to and use of the Service, you
agree to indemnify us and our successors and assigns for all damages, costs,
expenses and other liabilities, including but not limited to legal fees and
expenses, relating to any claim arising out of or related to your access to and
use of the Service or your breach of these Terms and any applicable law or the
rights of another person or party.
This indemnification section survives the expiration of your
registration and applies to claims arising both before and after the
registration ends.
Limitation Of Liability
In no event shall Snag Sight be liable for any losses or damages
that you (or any person claiming under or through you) may sustain, whether
such losses or damages are direct, indirect, immediate, consequential, or arise
from a contract, tort (including negligence), or any other cause whatsoever,
and fall into any of the following categories:

as a result of using the Service, copying, distributing, or downloading Content
from the Service.
In no event shall we be liable for any indirect, punitive,
special, incidental or consequential damage (including loss of business,

however it arises, whether for breach of contract or in tort, even if it has
been previously advised of the possibility of such damage.
You are solely responsible for ensuring that the data and/or
equipment you use in conjunction with your use of the Service is adequately
protected and backed up, and you agree not to sue for lost data, rerun time,
incorrect instructions, work delays, or lost profits as a result of using the
Service. You must not assign or otherwise dispose of your account to any other
person.
Without limiting the foregoing, in no event will our aggregate
liability to you exceed, in total, the amounts paid by you to us.

Your use of the Service is at your sole risk. The Service is
provided on an "AS IS" and "AS AVAILABLE" basis. The
Service is provided without warranties of any kind, whether express or implied,
including, but not limited to, implied warranties of merchantability, fitness
for a particular purpose, non-infringement or course of performance.

caused by any failure of performance, error, omission, interruption, deletion,
defect, delay in operation or transmission, computer virus, communication line
failure, theft, or destruction or unauthorized access or, alteration of or use
of record in connection with the use or operation of the Service, whether for
breach of contract, tortious behaviour, negligence or any other cause of
action.
We make no representations or warranties of any kind, express or
implied, about the completeness, accuracy, reliability, suitability or
availability with respect to the content contained on the Service for any
purpose. Any reliance you place on such information is therefore strictly at
your own risk. We disclaim any express or implied warranty representation or
guarantee as to the effectiveness or profitability of the Service or that the
operation of our Service will be uninterrupted or error-free. We are not liable
for the consequences of any interruptions or error in the Service.
Any download and use of the licensed web application and mobile
applications for the service is done at the licensee’s own risk and the
licensee will be solely responsible for any damage to – without limitation –
any computer system or loss of data that results from such activities. Should
it prove defective, licensee assumes the cost of all necessary servicing,
repair and/or correction. It is therefore up to the licensee to take adequate
precaution against possible damages resulting from the licensed applications
for the service.
Exclusions
Some jurisdictions do not allow the exclusion of certain
warranties or the exclusion or limitation of liability for consequential or
incidental damages, so the limitations above may not apply to you.

settings section of Our Web Application and Mobile Applications and/or on Our

Snag Sight Team has no control over, and assumes no
responsibility for, the content, privacy policies, or practices of any
Third-Party software, websites or services. You further acknowledge and agree
that Snag Sight Team shall not be responsible or liable, directly or
indirectly, for any damage or loss caused or alleged to be caused by or in
connection with use of or reliance on any such content, goods or services
available on or through any such web sites or services.
We strongly advise You to read the terms and conditions and
privacy policies of any Third-Party websites or services that You visit.
You shall indemnify and hold us harmless against any loss or
damage which it may suffer or incur as a result of Your breach of any
Third-Party additional terms howsoever arising. We may treat Your breach of any
Third-Party additional terms as a breach of these Terms.
Governing
Law
Our failure to enforce any right or provision of these Terms
will not be considered a waiver of those rights. If any provision of these
Terms is held to be invalid or unenforceable by a court, the remaining
provisions of these Terms will remain in effect. These Terms constitute the
entire agreement between us regarding our Service, and supersede and replace
any prior agreements we might have between us regarding the Service.
Changes
We reserve the right, at our sole discretion, to modify or
replace these Terms at any time. If a revision is material we will try to
provide at least 30 days’ notice prior to any new terms taking effect.
It is your sole responsibility to periodically check these Terms
for any changes. If you do not agree with any of the changes to these Terms, it
is your sole responsibility to stop using the Service. Your continued use of
the Service will be deemed as your acceptance thereof.
Feedback
It is expressly understood, acknowledged and agreed that should
you provide any reasonable suggestions, comments and feedback regarding the
Service, including but not limited to usability, bug reports and test results
(collectively, "Feedback"), regardless of whether or not formally
requested to do, you grant Snag Sight the following worldwide, non-exclusive,
perpetual, irrevocable, royalty free, fully paid up rights:

license terms that would purport to require Snag Sight to comply with any
additional obligations with respect to any of our Products that incorporate any

Should you encounter any bugs, glitches, lack of functionality or other problems with the Service or its applications, please let Snag Sight team know immediately so that the issues can rectified accordingly. You can submit requests and issues via our support desk. Your help in this regard is greatly appreciated.
Subscription Details:
Snag Sight application is free free for the first 15 days. No payment will be charged during this period and the users will have access to all features of Snag Sight. Upon completion of 15 days, you have to purchase one of the subscription plan (Monthly or Yearly). when you purchase one of the available subscription plans, you get unlimited access to all the features for a period stated in the plan details. This is an auto-renewing subscription. Payment will be charged to iTunes / Google Play Store Account at confirmation of purchase. Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period. Account will be charged for renewal within 24-hours prior to the end of the current period, and identify the cost of the renewal. Subscriptions may be managed by the user and you can turn off auto-renew in your Apple ID / Google Play Store account settings any time after purchase.. No cancellation of the current subscription is allowed during active subscription period.
